DMCA
At hodiva.xyz, we respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on our website infringes upon your copyright, we encourage you to file a Digital Millennium Copyright Act (DMCA) takedown notice. Below, you’ll find the procedure for submitting a claim.
1. Filing a DMCA Takedown Notice
If you are a copyright owner or an agent authorized to act on their behalf, and you believe that any content on this website infringes upon your copyrighted work, please send a written notice to our designated DMCA agent. Your notice must include the following information:
-
Identification of the copyrighted work you believe has been infringed. If multiple copyrighted works are involved, you can provide a representative list of such works.
-
Identification of the material that you claim is infringing or that is the subject of infringing activity, and information reasonably sufficient to allow us to locate the material on the website (e.g., URLs of the infringing content).
-
Your contact information, including your full name, address, telephone number, and email address.
-
A statement that you have a good faith belief that the use of the material in question is not authorized by the copyright owner, its agent, or the law.
-
A statement under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
-
Your physical or electronic signature (or the signature of the person authorized to act on your behalf).
2. DMCA Takedown Process
Once we receive a valid DMCA takedown notice, we will review the claim and, if necessary, remove or disable access to the infringing material. In compliance with the DMCA, we will also notify the user who posted the content.
If the user who posted the content believes the removal was made in error, they may file a Counter-Notice (described below).
3. Filing a DMCA Counter-Notice
If you believe that your content was removed or disabled due to a mistake or misidentification, you may file a DMCA counter-notice. The counter-notice must include the following:
-
Your contact information, including your full name, address, and email address.
-
Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed.
-
A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or misidentification.
-
Your physical or electronic signature (or the signature of the person authorized to act on your behalf).
Once we receive a valid counter-notice, we will forward it to the original complainant, who will have 10 business days to file a court action to prevent the restoration of the content. If no action is taken, the content will be restored.
